A member of the NDC legal team and National Communications Director of the NDC, Sammy Gyamfi has stated emphatically that the NDC won the Assin North seat fairly and squarely and that the party would do all it could to protect the seat.
Addressing the media shortly after the court sitting in Cape Coast Tuesday, Sammy Gyamfi indicated that due to the alleged biased statements by the presiding Judge, the first respondent, James Quayson has petitioned the Chief Justice of Ghana to intervene in the matter to ensure that the Judge, Justice Kwasi Boakye recuse himself to ensure justice.
“The statement the presiding judge made in court that day showed that he had already taken a position even before the counsel addressed him on that important issue. So because of the likelihood that there will be bias, and that the first respondent will not have a fair hearing before this presiding judge, the lawyer made an oral application for this presiding judge to recuse himself which he heard in chambers and turned down.”
Abraham Amaliba, one of the lawyers defending the National Democratic Congress’ embattled Member of Parliament for the Assin North Constituency in the Central Region, James Gyakye Quayson, in the dual citizenship case, however, applied to withdraw his services, citing comments made by the judge in previous hearing which he believes might constitute bias.
The court was unable to deliberate on Abraham Amaliba’s withdrawal case on Tuesday because the first respondent, James Quayson did not have a representation and therefore adjourned the case to 8th June 2021, when it is expected that the first respondent would be served properly on Abraham Amaliba’s application to withdraw from the case and thus introduce a new lawyer to represent him.
The Central Regional Secretary for the New Patriotic Party, Richard Mensah in an interview, however, maintained that the actions by the lawyer of the Assin North MP are a clear attempt to delay the case.
